A formal complaint has been lodged against New York Governor Kathy Hochul and other New York Democrats, accusing them of using their government positions to secure luxury suite tickets for a Buffalo Bills vs. Dallas Cowboys game. The complaint was filed by lawyer David Grandeu with the New York State Commission on Ethics and Lobbying in Government, claiming that the officials abused their power for personal benefit. The “I Love New York” suite where they were seated is controlled by the Empire State Development Corp. (ESD), which reports to Governor Hochul. Hochul, a die-hard Buffalo Bills fan, was joined in the luxury suite by New York State Assembly Speaker Carl Heastie and New York Majority Leader Crystal Peoples-Stokes for the game on December 17, 2023. Photos of the officials at the game were posted on social media, with Hochul joking about Heastie being a Cowboys fan. The Bills ended up defeating the Cowboys 31-10. ESD reported that charitable donations equal to the value of the seats in the suite were made, and Hochul’s office stated that proper steps were taken to sit in the suite. The donation was made to FeedMore WNY, and there were discussions about regional infrastructure and economic growth during the game.

A.J. Baynes, CEO of the Amherst Chamber of Commerce, confirmed that there were productive discussions on infrastructure with Governor Hochul in the suite. ESD spokesperson Matthew Gorton noted that Heastie’s office had requested the use of the suite, and all guests were informed about the rules regarding lobbyists’ attendance and reporting requirements. However, Grandeu believes that the charitable donations do not excuse the officials’ use of the suite for personal benefit instead of official business. He argues that using a government position to attend a sporting event in a luxury suite is unethical and should not be allowed.
