Attorneys for Hunter Biden and special counsel David Weiss are set to appear in court over the future of his felony tax indictment. Hunter Biden faces nine tax offenses, to which he has pleaded not guilty. His lawyers have made several attempts to have part or all of the charges thrown out, with the arguments to be presented in front of a federal judge in Los Angeles. The decision made by US District Judge Mark Scarsi on the fate of the tax charges could potentially impact the 2024 election, where Joe Biden is currently engaged in a tight race against Donald Trump.

Federal prosecutors have accused Hunter Biden of repeatedly failing to file taxes on time, missing deadlines to pay IRS debts, and participating in a criminal tax-evasion scheme by filing false tax returns and manipulating his company’s payroll records over several years. The indictment does not support the Republican claims that Hunter and Joe Biden unlawfully earned millions overseas together. Despite the impeachment efforts against him, Hunter Biden must still address the criminal charges against him, and his legal team has asserted that the case should be dismissed.

Hunter Biden’s lawyers argue that Weiss only brought the tax case due to pressure from Trump and congressional Republicans calling for his prosecution. They claim that his political and familial affiliations are being targeted, and the case has been tainted by the actions of IRS agents turned whistleblowers who cooperated with the House GOP impeachment inquiry. Special counsel prosecutors have refuted Hunter Biden’s theory that the charges were filed due to GOP pressure, stating that there is no connection between the prosecution and politicians influencing the case.

In addition to the tax charges, Hunter Biden faces a separate indictment in Delaware related to three alleged gun crimes, which he denies. The gun trial is set to begin prior to the June 20 trial date for the tax charges in California. Democrats had previously accused Weiss of caving to Democratic pressure to go easy on Hunter Biden, a claim that he has also denied.
